Corporates

Litigation, arbitration and alternative dispute resolution are some of the largest legal expenses incurred by businesses. Single or multi-party commercial claims such as breach of contract, negligence and misrepresentation are typically costly and unpredictable.  Businesses often forego pursuing legitimate legal claims in order to avoid the associated expense, risk, and distraction from core business objectives.

Litigation funding can reduce these concerns and allow a corporation to pursue its legal claims efficiently and at lower risk.   Corporations can also make an application for litigation finance for operating costs associated with litigation.

Applications can be made seeking bids from law firms for their terms of retainer to provide the legal services for both funded and unfunded litigation or potential matters.

Law Firm Retainer Bids

The legal costs associated with complex litigation can be very high.  Although in funded litigation, the funder meets all of these costs, it is in the interests of all stakeholders that appropriately experienced legal advisors are retained.  It is also necessary to ensure that the costs of the legal advice are at competitive rates to assist in the early resolution of claims and for obtaining court or other approvals of the settlement, common fund orders, competing class actions and generally.

An application can be made on Ceramic’s Litigation Platform in relation to either funded or unfunded litigation, seeking competitive bids from law firms for the legal services retainer.
